Z is incentivising the purchase of Caltex Lubricants with a chance to win two tickets to the 2024 ITM Taupō Super400 supercar race, a Prezzy card, and a tour for you and a guest of an active pit garage based on the following terms and conditions (“Promotion”). There will be three prizes. 

 

By participating in this promotion, you accept these terms and conditions. 

1. The promotion is run by us, Z Energy Ltd of 3 Queens Wharf, Wellington, New Zealand (“Promoter”).

2. The purchase period for the Promotion opens at 1am on 1 March 2024 and closes at 11pm on 24 March 2024 (“Promotional Period”).  

3. The Promotion is open to persons who reside in New Zealand and are aged 18 years old or over on the date of entry (“Eligible Entrant”). 

4. Employees (and their immediate families) of the Promoter or of a Participating Distributor are ineligible to enter the Promotion.  

PRIZE  

5. There will be three (3) prize winners. Each prize includes two trackside general admission tickets for all three days (19-21 April 2024) of the 2024 ITM Taupō Super400 (valued at $260), one $500 Prezzy Card and a tour of an active pit garage for the winner and their guest (“Prize”).  

6. The Prize is non-transferable and cannot be exchanged or redeemed for cash. 

7. Each winner and their guest are solely responsible for all associated costs and expenses associated with the Prize including transportation, accommodation, and meals.   

HOW TO ENTER  

8. To enter the Promotion, an Eligible Entrant must purchase Caltex Lubricants during the Promotion Period from any one of the following: 

a.  the Eligible Entrant’s account manager at Z Energy Limited; or

b. any one of following Caltex lubricant distributors (each a “Participating Distributor”): 

  • Trimac Services (Northland) 

  • BOP Oil Supplies Ltd (Eastern Bay of Plenty) 

  • Diesel & Turbo Wellington (Lower North Island) 

  • Heavy Diesel Parts & Services (Canterbury-Nelson & Marlborough)  

  • Westland Engineering Supplies (West Coast) 

  • McKeown Group Limited (Otago) 

  • Invercargill Oil Shop (Southland) 

 c. a Z Energy Limited sales agent (excludes purchases from Z retail and Caltex site), (each, a "Qualifying Purchase”).   

9. Subject to clause 10, each Qualifying Purchase will give that Eligible Entrant one entry into the Promotion. Multiple entries are permitted throughout the Promotional Period.

10. Entries are deemed received at the time they are received by the Promoter, and not at the time of purchase by the Eligible Entrant. To the extent permitted by law, the Promoter takes no responsibility for any failure of any entry to be entered into the Promotion due to, without limitation, technical malfunction or human error.   

DRAWING A WINNER 

11. Each Participating Distributor will promptly provide the Promoter with the name, email address, and phone number of each Eligible Entrant’s Qualifying Purchase from that Participating Distributor during the Promotional Period and any other information reasonably requested by the Promoter. 

12. Using the information provided by each Participating Distributor and Z’s own direct sales data, the Promoter will allocate each Eligible Entrant that made a Qualifying Purchase, a number. The Promoter will determine three Prize winners from all valid entries purchased during the Promotion Period, each by way of a random number generator. The Prize draw will take place at an office of the Promoter on 28 March 2024.

13. The winner randomly drawn in accordance with clause 12 will be contacted by the Promoter or their nominee via the contact details on file or provided by the Z Energy account manager or sales agent or Participating Distributor (as applicable). Entrants are responsible for ensuring the contact details associated with their account when making a Qualified Purchase are correct at the time of purchase.  

14. If, following the draw: 

a. the person drawn to win the Prize declines to accept the Prize; or 

b. the Promoter and/or their nominee is unable to contact the person drawn to win the Prize within 7 days of the Prize draw, having made reasonable attempts to do so; or 

c. an ineligible entry is drawn (for example because the entrant is not over 18 years), the Promoter may deem that person as having forfeit the Prize and the Promoter may draw a winner on the same terms and the original Prize draw. In that case, the original winner is not entitled to any compensation. 

15. If a winner cannot accept or take part in the Prize for any reason (including if the 2024 ITM Taupō Super400 is abandoned, called off, postponed or cancelled for any reason), the Prize will be void and no compensation or alternative prize will be payable. In that case each winner and their guest forfeit their entitlement to the Prize and the Promoter will not be liable to any entrant or Prize winner for any loss or damage incurred as a result. 

16. The Promoter’s decision is final on all matters and no correspondence will be entered into.  

GENERAL 

17. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, or the cancellation, abandonment, or postponement of the 2024 ITM Taupō Super400, the Promoter reserves the right, in its sole discretion, to disqualify any entrant and/or modify, suspend, terminate or cancel the Promotion, as appropriate. The Promoter will not be liable to any entrant or Prize winner for any loss or damage incurred as a result.  

18. Acceptance of a Prize is deemed consent for the Promoter to use the winner and their guest’s details for promotional and media purposes without compensation, and any copyright will vest in the Promoter. 

19. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 

20. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons. 

21. The six tickets forming part of the Prize can only be used once and will be deemed invalid if copied.  

22. The Promoter does not control entry to the relevant event location and is not responsible for the conditions of entry into any venue or location relating to the Prize.  

23. The Prize winner must keep their Prize safe. The Promoter will not replace lost or stolen Prizes. 

24. This Promotion is in no way sponsored, endorsed or administered by 2024 ITM Taupō Super400 or its organisers, who are in no circumstances responsible for this Promotion or the Prize. 

25. Except for any liability that cannot be excluded by law, the Promoter and Z Energy Limited exclude all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following:  

a. cancellation of the 2024 ITM Taupō Super400; 

b. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);  

c. any theft, unauthorized access or third party interference;  

d. any entry or Prize claim that is late, lost, altered, damaged or misdirected;  

e. any tax liability variation in incurred by a claimant or entrant; or use of a Prize. 

26. These terms and conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.   

27. Any personal information collected about individuals as part of the Promotion will be collected, stored and used in accordance with the Privacy Act 2020 and Z Energy Limited’s privacy policy.
